DESPLAZAMIENTO TRABAJADORES Hace unos días entró en vigor el Reglamento sobre las normas para el desplazamiento de conductores en el territorio de Polonia. Según este reglamento, un conductor empleado en una empresa de un Estado miembro de la Unió n Europea no está sujeto a las disposiciones sobre desplazamiento durante el transporte bilateral y de tránsito y, a partir del 21 de agosto de 2023, el transporte comercial cruzado durante el transporte bilateral, siempre que el vehículo utilizado para dicho transporte esté equipado con un tacógrafo inteligente de segunda generación. Para realizar transportes de cabotaje y de comercio cruzado es necesario notificar previamente al conductor al sistema IMI y emitir una declaración de desplazamiento. Un conductor empleado en una empresa de un país no perteneciente a la UE no está sujeto a las disposiciones sobre desplazamiento, únicamente cuando realiza un transporte en tránsito. Para realizar un transporte bilateral es necesario informar al conductor al sistema polaco (en formato electrónico) y emitir una declaración (en formato papel). A más tardar el día del envío, el transportista deberá presentar la declaración de envío en un formulario PDF interactivo y enviarla online a través del portal Biznes.gov.pl . La solicitud debe firmarse con una firma cualificada, un perfil de confianza o una identificación electrónica. La notificación de publicación del conductor contiene al menos la siguiente información:

Un operador de transporte por carretera de un tercer país que desplace a un conductor al territorio de Polonia debe asegurarse de que el conductor tenga a su disposición los siguientes documentos en el momento del desplazamiento: • confirmación en papel del envío de un conductor al territorio de la República de Polonia desde un tercer país; • prueba del transporte por carretera, en particular en forma de carta de porte, el permiso correspondiente necesario para el transporte internacional por carretera o el formulario de conducción en base al cual se realiza el transporte; • registros de tacógrafo. El conductor deberá tener estos documentos en el vehículo y presentarlos en el control en carretera cuando sea necesario.
